Dear Dr. Gale,

I have just read your appeal brief. It is well written. There is no chance that Dr. O. can succeed in forcing you out of practice. The evidence is clearly in your favor. I took particular notice of how Dr. O. was intimately involved in every facet of the case against you. He will not succeed. His attack on your career is eye opening. It is amazing
how much power he wields with no merit to his attacks. It is amazing how the board goes along with his dictates and CHANGES THE RULES along the way as it sees fit. State licensing is supposed to control the actions of persons not adequately qualified to perform the tasks for which the licensing is granted. The state licensing board is not supposed to interfere with the profession of those professionals properly licensed. The state of North
Dakota needs to put an immediate stop to this unethical behavior.

I cannot imagine the gall of the board members, with their limited training and credentials, criticizing your surgical care of your patients, while they are not qualified to perform such procedures--and then tell you that YOU need more training. When they are found wrong, THEY should be told to get more training. When you win, they should pay for all of the trouble they have caused you. They should be ashamed of themselves. How can they
sleep at night? Do they like that they have caused many patients to go without your excellent care? I believe that they probably wish they had never challenged such a quality podiatrist as yourself. I believe they were digging for some dirt and came up against polished stainless steel.

The digging for dirt that they did was certainly unethical and enough grounds for dismissal of the case. But the case against you is ridiculous since they failed to establish the minimal standard of care which they are supposed to use as their basis of allegations against you. They should say that the minimal standard of care for a podiatrist in North Dakota is perhaps what they would have done, since they clearly have minimal training. They have
decided that a remedy to your situation involves further training. Isn't a four year residency enough? --especially since they only had one year? So who needs more training. Not you.

I did not have four years of residency training. I had one year like they did. I clearly see that you are a better trained surgeon than I am. Your abilities and techniques are refined and more perfected. Dr. O. saw that you were a better trained surgeon than he when you were in practice together. You were clearly the one with the most advanced surgical skills. No one could question that fact. And yet they said that you were not even minimally competent to practice podiatry. AMAZING.

Isn't justice important any more. This whole thing should be dropped immediately. The law is supposed to be a servant to justice. Proverbs 19:8-10 says,

"He who gets wisdom loves his own soul; he who cherishes understanding prospers. A false witness will not go unpunished, and he who pours out lies will perish. It is not fitting for a fool to live in luxury-- how much worse for a slave to rule over princes!"

Proverbs 20:10-11 says,

"Differing weights and differing measures--the Lord detests them both. Even a child is known by his actions, by whether his conduct is pure and right."

Proverbs 28:28 says,

When the wicked rise to power, people go into hiding; but when the wicked perish, the righteous thrive.

Proverbs 29:2 says,

"When the righteous thrive, the people rejoice; when the wicked rule, the people groan."

Have you heard any groaning lately?
