Dear Supporters,
I realize that many of you have sent letters to the committees who have
heard 1262 and 1377 before. This should be the last time that I ask for a letter (at least concerning 1377). I know many of you are from outside of
North Dakota but I think that your letters are still very important. You can
let these senators know that the whole country is watching and that everyone
of you know that 1377 is a sham and would never have even been proposed in
any other state.
Olson is telling the Podiatrists in North Dakota that if 1377 doesn't pass, the Board will go bankrupt and the Podiatrists could lose
their licenses to practice. If you were a Podiatrist in this state wouldn't
you support 1377 if you believed this?
Olson and 2 of the other 3 Board members refused to participate in a phone
conference to discuss and vote on 1377. Olson and Mike Stone have been calling the Podiatrists in the state and intimidating them into giving them
letters of support. They have been slandering me.
Please send an email to the people listed below telling them that this is not right. Tell them that this is not just about Brian Gale. This is about
misleading people for self serving reasons. Read John McCord's article in Podiatry Today and tell me why wouldn't the Podiatry Board in North Dakota
at least consider settling this case with me? I can tell you why. Because that would destroy me. That wouldn't cost me hundreds of thousands of
dollars and hundreds of hours of extra work and years of stress. If this person is allowed to get away with this crime you will soon see that
the Board's lawyer, Gary Thune will quickly run up $50,000 in legal
expenses. If it doesn't pass maybe the Board members will change and this can all come to an end.
I have told all of the Podiatrists at our phone conference meeting that if
the Board members change and there are fair Podiatrists on the Board, I will
gladly take any discipline they determine is appropriate.

Legislative Assembly HOUSE BILL NO. 1377
of North Dakota

A BILL for an Act to create and enact a new section to chapter 43-05 of the
North Dakota
Century Code, relating to the authority of the board of podiatric medicine
to borrow funds from
the Bank of North Dakota; and to declare an emergency.
BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
SECTION 1. A new section to chapter 43-05 of the North Dakota Century Code
is
created and enacted as follows:
Loan for litigation expenses. The board may borrow from the Bank of North
Dakota,
and the Bank may loan to the board, funds sufficient to pay for attorneys'
fees and costs
incurred in investigations, administrative proceedings, and litigation
resulting from the board
performing its duties, subject to the following conditions:
- The board has depleted the board's financial reserves.
- The attorneys' fees and costs incurred exceed the total dollar amount of
all license
fees received for the year in which the board is borrowing the funds.
- The board is assessing the maximum annual renewal license fee permitted
under
section 43-05-15 at the time funds are borrowed.
- Notwithstanding section 43-05-15, the board establishes a seven hundred
fifty
dollar annual renewal license fee for each year following the issuance of a
loan
under this section, and the fee is maintained until the loan is fully
repaid.
- The Bank of North Dakota may not charge interest on the loan which
exceeds the
prime rate less two percent.
- The duration of the loan may not exceed ten years.
- Once the loan is paid in full, the annual renewal license fee reverts
back to the
amount established by the board before the issuance of the loan.
SECTION 2. EMERGENCY. This Act is declared to be an emergency measure.
